MLS Rule Update Notice - Effective May 25

Under the Shelter in Place Order issued March 17, some MLS rules were temporarily altered to help agents follow the new State and County regulations. With the recent changes to the Shelter in Place Orders that permit agents to show properties, these rules will return to their original status, effective May 25.

Supra Lockbox 
Rule 13.2.2
With the closure of our Alameda and Plesanton offices, we were unable to sell lockboxes so combo lockboxes were permitted if a member did not have a Supra Lockbox. Now that lockboxes are available for pre-order in our REALTOR Store, a Supra Lockbox is required for showing purposes (if a lockbox is used).
Required Front Exterior
Rule 11.5b
If the required front exterior photo was not uploaded, we were issuing courtesy notices, not fines. Front exterior photos will be required; this includes 'Coming Soon' listings. Fines will be issued for listings without the front exterior photo. (We recommend reviewing your listings to make sure each one has one required front exterior image to avoid violations/fines.)
Changing "Withdrawn Temporarily" to "New" status We permitted members to change the status to Withdrawn Temporarily to stop accumulating Days on MLS (DMLS). With an email request, we were changing the status from "Withdrawn Temporarily" to "New" for members who were ready to put the listing back on the market. With the updated SIP Orders allowing occupied homes to be shown (virtually and if virtually is not feasible by appointment only), we will no longer change "Withdrawn Temporarily" to "New" for listings placed in that status after May 25.
Showing Access Field We had disabled this field in Paragon MLS. This field is enabled in the Paragon MLS now.
URLs in Public Remarks
Rule 12.5.2
We allowed branded or unbranded URLs in the public remarks. We will only allowed unbranded URLs only in public remarks.

 

New Showing Information - Effective 11:59pm on May 3 (May 1).

Service providers that enable real estate transactions (including rentals, leases, and home sales), including, but not limited to, real estate agents, escrow agents, notaries, and title companies, provided that appointments and other residential real estate viewings must only occur virtually or, if a virtual viewing is not feasible, by Appointment with no more than two visitors at a time residing within the same household or living unit and one individual showing the unit (except that in person visits are not allowed when the occupant is present in the residence)

  • By appointment only

Virtual Tours URLs: Members are allowed to enter branded or unbranded virtual tour links in the public remarks (April 2).

Showing Information: Showings must conform to the strictest limitations imposed by any government entity for the jurisdiction within which the property is located. All MLS Participants and Subscribers are strongly encouraged to fully inform themselves of the Orders and Directives affecting the showing of property within the jurisdiction of the property. Residential viewings must only occur virtually or, if a virtual viewing is not feasible, by appointment (Vacant Properties only) with no more than two visitors at a time residing within the same household or living unit and one individual showing the unit (except that in person visits are not allowed when the occupant is still residing in the residence).  Members are permitted to add “Shown By Appointment” (Vacant Properties only) only in the confidential remarks.  All other showing instructions are not allowed in the MLS and will be removed.

What does 'vacant' property mean?
According to Alameda and Contra Costa Counties and the City of Berkeley, vacant means that no one is using the property as a residence or place of abode. A property is not vacant if the occupant is gone on a trip and intends to return. It is not vacant just because the occupant leaves the property during the viewing allowed by the Orders. The intent is the property is not occupied or used as a place to live, and there is no intent to use it prior to the close of the transaction (April 10).

MLS warning Pop-Up in the Listing Entry Module:  When adding a listing or modifying a listing, after you hit save, the warning below will pop-up. You must click on “accept” and hit Save again to confirm the changes you have made.

MLS pop up: Members are permitted to add 'Show By Appointment' information for vacant properties in the confidential remarks only. All other showing instructions are not allowed in the MLS. Per the guidelines, showings are to be by appointment with no more than two visitors and one individual showing the unit.

The "Showing Access" field in the MLS has been disabled in listing entry, search, and reports. 

Open House/ Broker Tour: 

  • Input and search feature has been disabled.
  • Information is not allowed in the MLS, including public and confidential remarks (March 20).
